Partiton suite

I had filed a suite for partition against my father in 2011 and the case is under ex-partie proceedings, but the order has not been able to be obtained since 2012.  People say that ex-partie is not easily granted by the courts.  I am really fed up with this.  The property belonged to my mother and now my father and his second wife have fully occupied it.  Instead of presenting in the courts, the property which was previously in my mother's name and then mine was subsequently got transferred in Nagar Nigam accounts to my second mother by my father directly which I do not understand how it was possible.  My question is whether I should continue with the legal proceedings knowing the fact that courts are not giving ex-partie judegments now a days and can I file any other suite against my father and second mother for their malpractices with the title of the house.   Please help me out

is your mother alive?

while litigation is on a disputed property cant be sold or gifted to someone until  the dispute resolved by the court.you file a suit for declaration of title and to declare the transfer as null and void
