Dear Esteemed Members,
Need a small clarity. The notice i've received from an advocate representing a Partnership Firm (two partners) mentions that he's been authorised to serve the notice by one Partner of the Firm.
If i'm not wrong both partners need to expressly agree in writing for a partnership firm to be able to file a case u/s 138 right?
The Partners are husband & wife. Husband has filed a false case. I intend to file counter case against them for trying to entangle me in malicious prosecution.
