Passbooks cancelled

We have 15 acres of Agr land for which we obtained passbooks 15 years ago. This consists of one share of our ancestral, one share bought from the brother of our grand father and the third share from another brother of grand father.

5 years ago our PB/TDs were cancelled by the RDO on the reason that these lands have not been disclosed in our Land Ceiling Declaration filed in 1976(i.e about 35 years ago). one of the grand fathers made a complaint saying that , and this grand father said this land belongs to them as they showed it in their declarations.

We appealed to the Joint Collect for revision. He declared that cancellation is incorrect. He further declared to take fresh declarations from us and take a decision on PBs. We submitted declarations to RDO (acting as Land Reforms Tribunal). These were sent to Tahsildar for verification who submitted a report stating that our lands are within ceiling limits. He also requested to reinstate our passbooks(we got a copy of this, thanks RTI). All this happened in 2010. Until now the RDO office did not pass orders for restoration. For the last 3 years to come for enquiry and we are attending, they are not saying what info they want, but just issuing standard notice for attending enquiry.

Now RDO office, gave instructions to Tahsildar, to enquire and submit report. We understand this Tahsildar is corrupt and scared what he would report. We don't understand what is the need for another report when there is report already on file.

What is the action that we can take now to ensure RDO passes on the report already submitted by Tahsildar in 2010? Can we approach high court for any directions?

You first obtain report copy from Tahsildar in 2010 and you can  file writ petition in High court.

Besides, you can make a fresh complaint with the Collector about the inordinate delay in disposing the pending petition for PBs despite clear mandate, endorse a copy to the Chief Secretary of the state government requesting their intervention in this matter.
