Case Study: Patent

Anand Rishi, a well-known Ayurvedic Physician applies for patent for the new medicine he invented which can completely cure Asthma. He admits that the new medicine is purely herbal and admixture of two known herbal plants, which when independently treated, would have different medicinal effects. He claims that it is a process of the combination of the two that gives the product the necessary curing effect over Asthma, hence the invention is novel attracting patent protection. Decide the issue in the light of Patent (Amendment) Act, 2005.
