Patra/apatra issue of row houses after year 2000

Hello,

We had purchased a property (A row house) back in 2005. The property is currently owned by a landlord (Pagdi system). Now there are re-development plans are going on under Mhada act. However, now as per Mhada rules "Houses after year 2000 will be considered as Apatra (Illegal). So we are few set of people who have purchased property after 2005. Now we have been intimated that you have to bring proof/documents which should be before 1996 only then you will be eligible for a flat in redevelopment or else your current house will be demolished and no space will be alloted to you elsewhere.

I need a solution to this. Can some one help?

Please clear this issue , You are second person to ask such confusing question. It seems you are all misguided without proper knowledge , or myself lack some correct knowledge or both of us have  different half knowledge

1) Who is owner of land as per land record ?

2) What is right of Mahada on land ?

3) Whether it is SRA (Slum developemnt Project )

Myself from thane city if you can come and show papers , I some time feel you all are misguided and doing many things legally wrong and people are taking you for ride. There was one lady who was talking such thing after house demolished she contacted in forum and now we are helpless , she too did not turn up when i called her with some responsibile person to analysis all document etc.

There is some terrible misunderstanding between you or me . And I need to clarify all things by checking docuements

Please just posting won't solve your query , this misunderstanding have to be solved by analysis of documents please show me documents, forget fees won't charge anything to see documents . But you need to come to my place in Thane City

Thank you for replying. Based on your questions, I have tried to answer below:

1) Who is owner of land as per land record ?

The current landlord says that the land belongs to her. But there is another part (A builder) claming that he is also the owner of the land. So I will have to check with the government officials who is the real owner of the land.

2) What is right of Mahada on land ?

The second party (A builder) has acted now with the help of other people in the slum to undertake redevelopment plan and the current owner (which she claims she is the owner) is opposing the project. The second party says that he will get Mhada to undertake redevelopment plan and in that scenario he will not consider people who have purchased houses after year 2000

3) Whether it is SRA (Slum developemnt Project )

Yes the builder has stated that he will undertake the project with help from Mhada. So I believe it will fall under SRA

1) Go to City Survey Office , get Property Card , get site plan of that plot , if measurement took place of land in past try to get measurement extract . This will give insight to primary materail facts of land . Advanced I will tell latter. To get property card you need to know survey no,/city survey no/tikka no. or sheet no. . If you don't have then with help of some one in City survey office you have to get it. This is very important. 

2) Go to slum department , where you pay seva shulka . 1) Get gazette notification of declaration of slum 2) Get measurement extract slum declared area 3) Get Photo pass register extract if your name is there in it /if photo pass you don't have then revert back after checking all

3) See builder is third party , although he wil come as person to help people he is there to earn profit and he can cheat you , you need proper purson while dealing with him. Myself very well versed with Maharashtra Slum Area Act 1971 . I can guide you very well and be sure I have studied this act many times.  but first you get papers which I say and that too on urgent basis and when you get it revert back to me

4) Most important thing 1) Maintain all records from the time you are there in your house 1) Electricity bill 2) Milk man bill, 3) Seva Shulka Receipt 4) Voter regisration 5) Aadhar card on that address 6) Pan card on that same address. 

5) If area is house is more than 300 sq. feet then try to show your family as two family , with every two person should different LPG cylinder. Sorry to forget to put LPG /Kerosene receipt in point 4. 

6) Once done what i told and proper files maintained. Then revert back after work done on this forum only then I will guide you further 

7) Most important thing before dealing with third party do meet me I will explain law to you properly but after you do what I said in previous points , don't meet me before I stated above unless until it is emergency

Dear Madhu,

My father bought house from a person on the name of my uncle. Now we made a paper on the name of father mentioning that the person sell house to my father in 1995. the paper is of 1995. The paper made with the consent of uncle. We show the paper to society for patra, but the society said this paper not valid. I have to prepare paper of 2003, since litebill on my fathers name from 2005. But if i made paper of 2003 then this was not valid as per SRA rule. the documents should have before 2000. In this circumstances please help me wat will i do.
