Payment of overtime

Hi there,

       I am from Kerala and i am working at a company which doest pay my last 2 months overtime money .while we ask they are saying that "the money will come , just wait for a little bit more" . So i would like to know more about the payment of overtime , and on which date will they get paid and it comes under which law.              

                               Thank you  , pls help me

if they dint pay just send them a notice asking as to why they are not paying the overtime money and insist them to do so within a reasonable time (may be a month or so) failing which you might move to the labour court

OT should be paid alongwith monthly wages and reflected in monthly pay slip.

Download proof of OT.

Demand in writing under proper acknowledgment.

The employer has to record OT in various registers that it has to maintain.

Please demand in writing. OT should be one and half of the usual rate per hour. If not paid, you can send legal notice.

You have not mentioned what is this establishment; Commercial, Industrial?

Accrodingly look into; Kerala Shops & Estbs Act,  Kerala Shops & Estbs Rules

or Factory Act

There OT hours, payment of OT, date of payment, capping on OT, delayed payment and recourse  etc everything is  described.

 

You can approach Inpspector appointed under the Act.
