Pedestrian accident

A person driving motorbike within speed limits not under the influence of alcohol on a busy traffic road.

A pedestrian neglienntly jumped over the divider while crossing the road leading to an accident with the motorbike.

In this incident the pedestrian lost his life & the motorbike rider suffered multiple skull injuries & he was admitted in the hospital in an unconsicous state.

The motorbike rider is been charged under rash driving & death by negligence.

The traffic officer present on duty has filed a statement that there was negligence on part of the pedestrian.

 

 What should be the line of defence of the rider?
