Per appearance situation

In case the client engages an advocate on PER APPEARANCE basis, whether a fresh Vakalatnama specifying the appoinment for the single appearance is to be filed on every date.

                    ( If a general vakalatnama is filed, the danger may arise that the client may avoid to pay the fee for the next date; and the advocate justifibly not appearing may be dragged to the consumer forum for deficiency in service.)

For every appearance a vakalatnama cannot be filed and it is not practical too.

 

Secondly, in a recent case the supreme court has held that an advocate cannot be held liable for deficiency in service and hence there is no problem in filing a general vakalatnama.
