Perjury in divorce case against witnesses

Hi All,

 

1). During cross-examination of PW.1/Wife in Divorce case field by wife, the PW.1 stated that the PW.2 is eye-witness to the alleged incidents.

 

2). During cross-examination of PW.2 stated that PW.2 is NOT eye-witness to any of the alleged incidents between wife and husband.

 

Can I file Perjury on PW.1 for saying that PW.2 is eye-witness to the alleged incidents between wife and husband.

You could. But then it would have been a stronger case if the assertion in the evidence was slightly stronger instead of merely wrt the presence of the witness.

As per PW.2, witness never travelled to the place of PW.1 where alleged crime happned ... so saying PW.2 is eye-witness is not possible to happen. PW.1 lived in Bangalore and PW.2 lived in Hyderabad ...
