Plagiarism?

Hello experts,

I recently read a news that a group of singers and their company were criticized the netizens were accusing them of plagiarism because they were wearing the same clothes as another singer in the music video. Can such a situation even be called plagiarism? The clothing was traditional clothing to their culture so anyone can wear that right? Why would plagiarism come up?

Does plagiarism within fashion industry exist in India? Are there laws regarding that?

Hello, thank you for your query.

Intellectual Property Rights (IPR) is the rights of a person over their intellectual creation, that is, creation of the mind, such as art, writing, invention, etc. IPR extends to the Fashion industry as well. The fashion industry comprises designing, manufacturing, trading clothes.

In India, in order to protect designs applied on clothes in the fashion industry, the Indian legislature has enacted The Designs Act in 2000 which is different from the Copyright Act of 1957.

Hope this helps you.
