Many people seek to know about MoU ( Memorandum of Understanding ) with their wives, extracting a
declaration from her that she will not file any more cases against her husband and his family members
,…etc.
She too signs this MoU in the hope of getting the MCD ( Mutual Consent Divorce ) and permanent alimony.
Of course the MoU has other terms concerning the kids and visitation.
If she still files a case, this MoU can be produced and used as a point to prove how cruel she is.
Ok. So what if it is proven that she is cruel ??? Does the court immediately tell the husband “ Right now,
all the 498A and other cases filed by her, stand quashed and you can go home and forget that you met this
woman in life “ ?????

Ali-Baba and Forty Thieves Story in some Movie.
In real life, it does not work that way.

Please understand that this MoU ( Memorandum of Understanding ) is NOT LEGALLY BINDING upon the
wife.
Even after issuing one such MoU, she can go and file a 498A, DV, 3 & 4 ( Dowry Harassment ), etc etc etc
against her husband and his family.
She can even go on to say that when she signed the MoU, it was under DURESS ( Pressure ) and that it was
a FORCED MoU since she was threatened that her ENTIRE FAMILY will be WIPED OFF if she did not sign the
MoU.
She can smartly say that the Circle Inspector of Police was also there at the scene when she was threatened
and he too threatened her and her brother and said he will fix her brother in a false case if she did not sign the
MoU.
She might even accuse the Circle Inspector of threatening her that he will book her father under Immoral
Trafficking Act ( Pimp ).
Now, the Circle Inspector would not at all have been there. So, He will now pull your collar and start showing
his power against you.
From one side you will get thrashed by your wife and from another side, by the Circle Inspector and the Police.
So in addition to matrimonial case, you will have a crime case against you. Double Trouble.
This is exactly what your wife wants. As a woman, with her unique ability of soft-power, she knows which
person to throw against you and watch the fun. As a woman, she also knows the art of exit without a
scratch on herself. So, play it cautiously. She can speak any lie, if she really wants to. So, be careful.
I am referring to the Ten Percent Abnormal and
Dangerous Women and her people, all with
Psychiatric Illness and NOT to the genuinely
devoted and noble and normal women who
constitute the Ninety Percent of population of
women.

FIRST OF ALL, you do NOT need an MoU at all. Please understand this.
Guys, USE YOUR BRAINS. You need her signature on the MCD ( Mutual Consent Divorce ). That is all.
After signing the MoU, If she files a case against you ( which she WILL DEFINITELY DO to extract more
money, this money not shown in the MoU but received in Black and not shown anywhere ), then What do you
gain by showing at the police station that she has signed the MoU and is attempting to file a case ?
The police is bound by law to accept any complaint and issue an acknowledgement.
No Law can prevent her from filing a case against you and your people, since it is in her CONSTITUTIONAL
RIGHTS to file a case seeking action against the ones who harmed her and also seeking POLICE
PROTECTION.
If she is prevented from filing a case against you, HER CONSTITUTIONAL RIGHTS are VIOLATED.
Secondly, understand that AS A COMPLAINANT, SHE IS REPRESENTED BY THE STATE.
Truly speaking, SHE DOES NOT NEED AN ADVOCATE AT ALL.
If she and her rights are not protected, she can CLAIM FOR DAMAGES OF SOME CRORES OF RUPEES, by
filing a case against the STATE GOVERNMENT, CENTRAL GOVERNMENT AND EVEN THE HOME
DEPARTMENT. SHE CAN EVEN PETITION THE HUMAN RIGHTS COMMISSION AND THE WOMEN AND CHILD
SAFETY MINISTRY.
So, on one side, ACCEPTING HER COMPLAINT but on the other side, SUPPORTING THE ACCUSED
( YOURSELF ) cannot be done by the POLICE since in that case, IT WILL BE SIMILAR TO ONE HAND OF A
PERSON CUTTING HIS OWN HAND.
STATE CANNOT FIGHT WITH ITSELF.
COUNTRY CANNOT FIGHT WITH ITSELF.
That is why even the POLICE tread with lot of caution in matters concerning the COMPLAINANT, in any case,
whether it is matrimonial or otherwise.
In any case, even if you are a complainant AND victim, the Police will tread with lot of caution, since as a complainant and victim, you
are represented by the State and if the matter reaches the court even for a case closure, the Magistrate will
ask you if you approve and are OK with the case being closed.
The Asst.Public.Prosecutor and the Public Prosecutor are there for you, when you are the complainant and victim.
*** So, be SMART and MAKE THE TERMS OF THE MoU, included in the MCD PETITION ITSELF.....
INCORPORATE THE TERMS OF THE MoU, as a part of the MCD Petition itself *** NO NEED FOR A SEPARATE MoU.
*** In the MCD, under the column of PETITIONER 1 ... Add her name and under PETITIONER 2 ... Add your name..... ***
So, it is she who has initiated the MCD.
Actually, petitioner 1 and 2 do not matter in a MCD, since it is MCD --- MUTUAL CONSENT ----
But for practical argument purpose, you can make her the PETITIONER 1.
