Please help

Respected Sir ,

I am employee at one of PSU in country , due to my family responsibilities and other problems , i was on leave of 1.5 years from my office . I was unable to recieve communication from thier side , and didnt replied , henceforth they initiated discriminary proceding against me of taking more than 6 month leave without approval .I agained joined back last month and after 17 days i had given resignation , but they are not accepting the same saying that as prociding has been intiated & yet to be concluded so you cant be relieved , and they told me to continue job , I am having  family problems and cant continue any more but they are not ready to accept my resignation , I had asked some seniors in my office they are saying that it might take 10-11 months more to conclude inquiry and they will punish me minor penality of withholding increment or promotion or in severe case they can terminate you(no one has been ever terminated in company)  , but I am myself giving the resignation then what is the problem , as  i am accepting all my fault and ready to quit job , I have only served for 1 year and no other charges are against me , then why the company is torturing me to that level ,their are people who have done high level of corruption are being not touched and are enjoying ,my fault is not so serias still i had to face such things

Please suggest me some valuable suggestion i will be very grateful to you all

You have not acted properly.

You should have applied for leave, and responded to the communications.

The bosses are right as usually this is the outcome of inquiry.

The precedences may/may not help you.

 

Hope you have copy and acknowledgment of resignation.

 

Show all docs on record to an able labor Law Consultant and act under expert advise of your counsel well versed with domestic inquiry also.

1) Its immaterial blaming your superiors corrupt against whom if any to enquire seperate mechanism exists.

 

 

2) Instead of realising your mistake, you are counter charging others.  The Management is quite considerate in treating you rather would have treated your such long absence as voluntary cessation of service.

 

 

3) The punishment depends upon the outcome of the enquiry and the cirumstances presented by your defence assistant for your unauthorised absence and plead condone the guilt.

 

 

4) If you cannot continue in service, request for expeditious disposal of departmental enquiry as the lone charge being unauthorised absence and that no other charges prevail according to you and get your resignation accepted and settle your dues and get away.

 

 

5)  There must be some provision under admitted misconduct which normally does not attract capital punishment but goes with warning or censure or maximum stoppage of increment as stated by you depending upon the Disciplinary Authority.
