Please help false dowry case

Respected Sir/Mam,

My brother was married to a girl 1.1 years back, Soon after getting married my brother and her wife left for Rampur, (place where my brother was working at that time as a Agri Loan Manager), He purchased a agri land at my bhabi's name taking all loans from bank, friends and relatives. My bhani was having issues with my sister as she is young and used to tell her to help mother,( she only visited her inlaws for 45 days in whole this period), My bh\rother changed his job as he had to travel a lot in that job and bhabi was afraid of living alone so He used to drop her at her home at Shimla(H.P.). They both relocated to Siliguri( West bengal for a new saled job) they lived in a hotel for first 15 days as my brother had to attend the training soon after that they managed to rent a home for themselves and for office as it was a start up. Bhaiya had to work very aggressively it is a target job and he was supposed to set up business. Soon we got to know that they are fighting as my bhabi used to say that bhaiya is not staying with her for whole day and she is frequently alone.( Subha jaa kar shaam ko ate the) or he used to work at home many times and was into his work completely.

When my brother got back from Assam after one of his business trips he found out that bhabi was with driver into relations. he slapped her so did she bhaiya took her to hospital. got to know she is pregnant. She said sorry everybody was happy. Next montha she had her Graduation finals so she accompanied bhaiya to Delhi, and left to Shimla alone at her home.

Its been more than 4 months and she is not getting back. My bhaiya and Mother has visited her 4 times but she didn't returned.

A first and second visit she said will be coming back soon wants to stay with her mom.

third time she said she is not in love with my brother and she will never return, her parents said they will convince her and she will be back very soon.

My mother visited her again on 5-06-13, they were very rude to her, she was told that they are filing a dowry case and will put us all behind bar, we inclued my brother who is in Siliguri still shocked and confused, my sister who is at HPU giving her final exams staying at hostel, my father who was never involved in any sense, me I hacv\ve been married for last 2 years an am staying at Delhi.

We all are afraid,

pls help everybody is saying we are struck.

What can we do to save my family

File a complaint in the police station about the threats given by your bhabi's parents that they will falsely implicate you in dowry cases.

Thanks Ma'am,

We tried that but a known DSP informed it will only worsen situation. As we don't have any evidenc e for the same. We all are not even together, My sis at Simla her finals are on I am at Delhi and my maa papa are alone Papa is at hospital he is a blood sugar & high BP patient got admitted today morning Bhaiya is at Siliguri.

how will we be able to prove any thing and where should we file FIR, at Shimla or at Siliguri?

Do what you are told by Adv. Archana. File NCR(non cognizable report) to police againist your bhabhi that such and such threats are given to you.

Are you sure abt the relation of your bhabhi with driver? If not, never make such false allegations, she is still your bhabhi.

Are you sure abt the relation of your bhabhi with driver? If not, never make such false allegations, she is still your bhabhi.

I am not sure about anything as I am not living with my bhaiya bhabi this is something she told me over phone she said she was alone and bhaiya always leave her for one two days when on tour, she said it was a mistake it will never happen again and she loves my brother I suggested not to tell this to anybody home. She did same her mother & my brother are the only people who know it.

she has her medical report for her head injury when they both had a fight, it is written in it that she slipped in bathroom after having a quarrel with my brother. She can use it againt us.

My question is if we are to file an fir than from which location?

From Siliguri- where they were living,

From Rajgarh (H.P.)- where my parents live,

Or from Shimla (H.P.)- where my Bhabi lives.

If she wanted to file domestic violence, she should have done 4months back. Now it doesnt make any sense. even if she does, it is seen as a counter blast for your NCR(not FIR).

Any way in your discussions with your bhabhi, ask for marriage counselling and send both of them for it. Keep recording the discussions with your bhabhi in a recording device which might help you.
