Police inaction after fir

Hi,

A Complaint was made to Police U/s 420/406/120-B/34 IPC but no action was taken.

The Complainant was constrained to move an application U/s 156(3) before the Ld. MM.

The Police had filed a status report that despite several summons by post and by personal visit of Police official to the address of the accused he is evading the police and not participating in the Investigation and after a period of 1 year an FIR was ordered to be registered and the file was consigned to the record room.

Now despite more than 2 months having passed after the registration of the FIR, the police has not taken any action againt the accused persons who are roaming around free.

What are the options before the complainant regarding the non action of the Police??

You can make a representation to the court that the police are not following up the process of arrest.  Alternative you can also meet the higher police officials i.e. ACP, DCP etc.

Dear Rahul, First approach IO talk to him and ask these questions. If you don't get answers then meet SHO / ACP /DCP. You can ask similar questions in RTI application. YOu may file an application before concerned Magistrate (who has ordered for filing of FIR) with request to monitor the investigation as provided by the Apex Court in Sakiri Vasu v. State of U.P.: AIR 2008 SC 907.
