possession is not clear then 452 ipc is maintainable

This can Vary from case to case according to the facts of the case. But generally where the house is in no ones possession or where the owner of the house is not known the case under Section 452 IPC cannot be maintenable. Because the ingridient of the case requires trespassing in someones property.
