We have 6 buildings and 94 flats in our society. Our society is registered under Maharastra Co.Op.Societies Act.
Out of six buildings only building with 16 members has formed an FSI committee and started constructing additional FSI of their building from their own fund which would give an extra room for each member of the building except for two members of this building. This two members have given an undertaking to the society that they are not interested in FSI and therefore are not contributing any money for FSI. Now one of the non-contributing member of this building wants to sell his flat but the FSI has committee is objecting to it and has asked the managing committee not to issue NOC to the seller. The FSI committee is demanding money from the seller for the common plinth and column which is common for the whole building.
My question is is the FSI committee justified in asking the managing committee not to give NOC without FSI committee's consent?
