Previous maintenance due from mhada

Hi, I purchased a home from MHADA through lottery, have paid complete price and all taxes and got ownership transferred to my name. this flat is in the complex where society has been formed 5 years back. Flat allotted to me by MHADA was vacant for last 5 years. Society has charged maintenance charges on this vacant flat towards MHADA, MHADA has not paid any maintenance charge. Society denied us membership unless dues are cleared on the flat. Under pressure from society we paid the dues and now want to claim refunds from MHADA but they are not entertaining us...what should be the approach now.

Please indicate how much amount you paid to the Society towards 5 years arrears of maintenance charges.

Maintenance charge of 2,85,000 and interest of 85,000 we have still not paid the interest and requesting society to waive it off...society charges interest at 18% pa

You ought to have checked up prior to taking possession.

In any case, before paying to the Society, you ought to have approached a Court of law.  Now, having paid, it will be an uptil task to get the refund from the Society.

Even MHADA will not reimburse you the amount, unless there is something in the allotment letter (which I suspect may not be there).

In any case, please consult a lawyer in your locality and explore the possibility.

As things stand, you have a very bleak case.
