Proceedings against dowry case

Can an expert tell me the simplest way to proceed under 498a and 406?

There are many simple ways to proceed like:

 

File a complaint in a local police station

OR

call 100

OR

file a complaint in near by "Crime against women" cell

 

These complaints could also be filed by registered post by a letter but better you visit personally.

 

Have you tried counselling? Before proceeding I would advice you go for counselling. Many problems and issues gets resolved there. Filing a criminal case in like hitting the last nail in the coffin. After a criminal case, marriage gets fractured permanently. You could drag it forward but cant make it function as required. Your life you decide!!

yes,  counselling has in the court.

I tried best but the other party already eaten me in toto. No sign of remorse or repentence. Getting more adamant

What to do? Character is doubtful.

How did you direct moved court? Made a private complaint or police complaint?

 

498a is yet a non-bailable, cognizable and non-compoundable offence which is not against a person but against the society. When you are already in court why not move an application for divorce based on the allegations under 498a?

 

If you want divorce and the other party is at fault, you would also be entitled for maintenance.
