Self acquired property by Brother

can you explain.

we were both partner before self acquired.

O K,Sister share is allowed.

 

But when.Is it immediate or during the sale.

 

As now we are earning from the property & no question of sale.

The succession opens on Date of death of owner.

Legal heirs/successors have share immediately afte death of owner.

Generically speaking: If sisters have a share then they have a share in rent also.

Yes property is earned by we two brothers in one he is partner & other he is proprietor.

The mother (from ClassI relations) has pre deceased your brother?

The father (from ClassII relations) has pre deceased your brother?

You should have replied to it.

It has already been posted that:



If  as on date of death, there were no heirs in Class I relations, and Category I in ClassII relations(Father) the property will given to the heirs within Category II of Class II relations.  

In your case: Brother(s) and  Sister(s) (from  Category II) shall share equally.

Did your mother and Father both die before time/date/month/year of death of your brother?

My parents Father & Mother died before death of my brother..

Father died before seven year & mother died before 30 years.
