whether your sister agrees for settlement or not doesn't matter because all 3 will have equal share. your mother can execute will about her share. you can also execute will for your share.

since the property consists of independent house, which cannot be divided into 3 equal parts. only the sale proceeds can be shared. Let the house be transferred on your mother's name.
