Property case by successor of previous - 1 owner

City: Bangalore My father had brought land from a person 'X' who had in turn brought the land from 'A'. My father has constructed house and has been residing there from past 27 years and has obtained BBMP A Katha. Currently, the successors of 'A' have filed a case on the property. - what is the best possible solution? - can I rent out the house under this situation?

Is there any Court order restraining you in any manner in regard to the property in question?

Hi Ramachandran,

There is no such order yet. I havent received a notice of summon from the court yet as it was recently filed.

There wer makings on the wall with the case number and i found the case details online. I am hoping to know how to proceed?

In any case, unless there is any specific orders from the court restraining you from dealing with the property in any manner, you are free to rent it out.

Thanks. I heard that the people who gave the case have scribbled the number on the wall.

My primary aim is to remove the case as we canted to sell. With the case on the property, it cant be sold. Is there any counter case or anything that can be appiled to get the property cleared?

Unless you get notice of the case from the Court, the question of doing anything in the matter by you simply does not arise.
