Property distribution

if both parents die without making a will and have only 2 daughters and their naani (mothers mother) surviving who will get shares in their property. can naani claim a stake in their property. if she can, on which property both parent or only on mothers propery

Mother's mother has no legal right to claim property of your parents property.... she has right to claim her sons property....

thanks mahesh for such a prompt reply.

But their is a legal heir certificate given by tahsildar in kerela (some property belongs their) which includes her name. is that legally correct.

As per law she (nani) may not be a legal heir of your parents .

Naani cannot be LR of deceased in succession,

However, she can get the property by execution/ bequething of a will in her favour, then the property can devolve upon her (Naani).

Once the deceased are survived by class I legal heirs, question of  class II or any other distant heir does not arise, thus the grandmother, i.e.,mother's mother is not entitled to any share in the property legally.
