Property (on mothers name) to be shared to sons

Hi,

Currently i am staying in my father's home. which is his self earned property. but he registered in my mom's name. Mom is expired. as it is on my mothers name, it is sharable to all i.e. daughters also. but father wants to share the home to sons only. which is the best option to complete the activity without any issues and in future.

1. Name transfer from MOM to Father and finally sharing to sons

OR

2. Father can prove it as self earned property (since one of the witness is alive) and finally settlement to sons.

Kindly suggest me the best way.

Note:- verified the registered document and it does not contain a word about self earned by father.

1) if the property is on your fathers name and if property doesn't come to your father from his forefathers then it is clear he can give it to anyone .

2) As it is now on your mother it creates a situation as everyone has  a share in it. Property cannot be registered on your father anymore without everyones knowledge.

3) My suggestion is to share the property with even sisters knowing and with their signatures on the registration document.

Thanks,

Mahesh
