Property partition disputes with brother

Hi Gurus, Seek your expert advice on action to be taken by me.

Family members purchased a Flat and registration done jointly on my Father and one of my Brother’s Name.

My brother took the loan on his name + father's name.  He used to pay the EMI From his saving account. After few year, father took voluntary retirement. Post brother has converted all the loan on his name.

After few year, even he removed my father’s name from Co-op Certificate without father concuss.

My father dismissed last year.

Now he is planning to sell the flat.  Also he is claiming that all the amount (EMI) + Downpayment was made from his saving account. Dad name he kept only for reaching the eligibility of loan amount.

What can I do to get my share.  What all the option I have of claim.

Sir,

 

First of all you should challenge the document qua which he has transferred the house in his name, and claim partition on the same ground becasue the money paid by your father will be shown in the the bank transactions qua which the money has been paid.
