PROPERTY SHARE

A 'husband' has acquired a property out of his hard earnings and registered the same on the name B 'wife' who is house wife. These two have 3 children which includes two sons and a daughters. Subsequently, both A and B died.

Can you please let me know that what would be the individual share of 3 children?

You have not cleared the deceased person belonged to which case? whether, Mohamedan, Hindu, Cchristins, sikhs... Seperate law govern in the distribution of share.

Each gets 1/3 share as the property is intestate property in the name of  woman. Because, as per Hindu Succession Act, the property in the name of woman    is always considered to be as self-acquired property of her.

According to Hindu Law, any female who dies intestate, her property (whether self acquired or inherited) shall devolve upon her children equally. For more clarification, go through Section 14 and 15 of Hindu Succession Act, 1956.
