SIR Classic case of builder chetaing'

 SHOPKEEPERS OF A COMPLEX HAVING REGD SOCIETY HAS FILED 08 MONTHS AGO CIVIL SUIT FOR MAINTENCE HANDING OVER ALONG WITH FIXED ASSETS FROM BUILDER AS BUILDER HAS FAILED ON ALL COUNTS .

MY QUESTION IS THAT CAN BUILDER DESPITE CASE OF SOCIETY IS IN CIVIL COURT CAN NOW SEND NOTICE FROM HIS SOLE ARBITRATOR TO ADJUDICATE now  for old payments despite no service on  INDIVIDUAL SHOPKEEPERS.

KINDLY PROVIDE FEW JUDGMENTS IN SUPPORT IS IT MUST TO REPLY ARBITRATOR NOTICE OR IT SHOULD BE IGNORED
