In a case, defendant died. Application to bring his legal heirs were filed. its notice were not served duly by ordinary way. Court orders substitued service by Publication of Public Notice thorugh court in daily news paper. It was published. None appeared from LR. court ordered to amend plaint n join them as LR of deceased defendant. Then, amended plaint was filed. its summons issued to LR, Again it was not sereved. Court insist for Public Summons again if its not served in ordinary way. Now question is whether is it necessary to publish once again Public Summons when in first instance they were not aapeared ?
I have worked with Order 9 read with S.141 CPC.
any ruling in that regard ?
