This matter relates to Investiagtion of Matter by Nawanshshr police in Punjab on complaint of Canara Bank.
Some 3 years back some unknown person withdrawn money from one bank account by cheque book issued by bank. The cheque book was taken out by manager of branch without any other person knowledge with single signatures and entered into manual register. Later on asked other officer to enter it in computer to that person.
On basis of this cheque book, the person withdrawn money from the account at different times and clerkss at the counter compared his signatures with cheque and in record. I t was manager who has taken cheque books from storage and asked for issuance. All clerks gave evidence to police for this thing
The Economic wing investigated the matter and placed a report before S.P (Detection)and it was recomended for registration of case against Manager. The report held other employees not involved in fraud. The report was placed before SSP Mr. Bhargav for signatures and registration of FIR.
The SSP under political influence held file for 6-8 months in his office and asked EO wing to change it silently. The New IO of Eo wing without taking any statements of clerks and giving any notice, made new report accusing another employees. The report held that Manager only handed cheques to clerks and they did fraud without any evidence proved or in possesion.
The Bank already did internal inquiry and held Manager responsible for fraud and dismmised him from Job. Bank
held other employees who passed cheques negligent for following proper procedure and fined them.
Now what recoourse is there for Bank employees who were not involved or passed cheques in routine. Can they produce old report in court during bail or quashing the FIR. I think FIR is not yet registered. Is it not denial of natural justice by police for now giving person chance to speak up and prove its innocence. or just police want to register FIR and Courts deal with it for 8-10 years. It has serious consequesces on person health, family and social links.
