Queries regarding apartment law maharashtra

Builder in our complex has made Deed of Declaration and registered it so that an Apartment can be formed. None of the the members want to join the apartment and want to form Co-Operative society. Can we form society on our own.
Further, Deed of Declaration mentions that the present and future FSI/ TDR along with right to construct additional floors are with the builder. Can builder keep such rights with him. Won't those rights cease when society land will be conveyed in the name of society.
Our housing complex in in Pune. Please guide us in this matter.

yes you could form a co-op. housing society. you need not join the builder. if the builder has written to you officially to co-operate with him for forming an apartment, then you all members need to communicate him in writing about your intention.
