Query on gratuity

Hi,

A collegue of mine had worked in his previous firm for 4 years 8 months (01-02-2010 to 31-10-2014). His employment was permanent and the firm is not seasonal. 

I would like to know whether he would be eligible for Gratuity Payment. 

Will calculation of 240 days of continous service in the fifth year be considered for coverage. If so can declared holidays and Sundays be considered for calculation of 240 days of continous service?

What are the options available for him to claim his Gratuity from his previous employer?

Yes to all.

If employer has not paid on its own within 30 days then he may submit FormI under proepr acknowledgment and claim 10% interest for the delayed period.
