Sir,

1.in my mcd case out of court payment of one time permanent alimony receipt neglected to be filed with mcd petition along with other documents.

   Result:wife cheated and case dismissed.

a) is receipt primary evidence or secondary evidence as per evidence act?

which section of evidence act deals with it?

b) fact about payment not noted by lawyer in mcd petition

which section of evidence act deals with it?

2) in case I appeal in high court what Is procedure involved?

  Two things in my case

  1. Contempt of court

  2.criminal cheating by cut throat wife

 Can both things clubbed together in my appeal?

You should not have paid money out of court,  you should have paid money in court hall where she she takes money and signs the papers.

Now money is gone.  Now cant do anything, she ate off money, thats all.  Now you can apply for normal divorce and contest it till you get it in the same court, no need to go to HC.

 

In court we wont get justice especially for matrimonial matters, neither can a troubled husband can get relief not a troubled woman can get relief as  nobody is sitting there to give hanging orders or giving death penalty, they just give orders of divorce or wont give orders of divorce and make life of litigants living hell.

 

It is better to involve elders and ask them to give divorce via MCD.  Or else for such kind of women you just go your way, you do what you want, court cannot do anything to you even if you remarry, just make sure that you wont leave any proof of marriage if you want to re-marry.  If marriage is not on your mind, and if lots of property in your name sell it off to someone, keep money in your bro name or your mom name or sister name, play hide and seek, your wife can just file alimony case on you, even if you dont pay a penny nothing will happen, show that you are unempolyed, register yourself as unemployed in employment buro, get letter from them, there are many citations not to force unemployed husband to pay alimony, if it comes to warrant issue etc, pay little money, 1000 - 2000 whenever there is threat of warrant issue for not paying alimony, she played with you, now its your turn, play, but dont forget to live life, getting divorce, getting married, itself is not life, there is much more to life than this.
