hello, we have a filed civil suit for getting a direction to get sale deed registered .this is due to a land sale transaction issue and the seller gave issues after collecting the funds. case was filed and inspite of filing a vakalat , no written statemnt was filed by the defendant(one only) and finaly a exparte order was given last month with direction to get the sale deed registered in a period of 3 months. i wanted to move forward with a executiton petition in this regard, but i also just came to know that the defendant had filed a petition for exparte set aside.we have followed all the due procedures of summons.
kindly advise how long does it take for ths set aside to be decided and will it have any binding on my execution petition process.also, is there anyway i can oppose the execution petition to be allowed on frivolous grounds.
