THIS IS A COPY OF THE REJECTION ORDER PASSED BY THE RETURNING OFFICER. => “Candidate Sri Gyanendra Kumar Tripathy has neither mentioned the Part Number(s) nor Serial Number(s) of the Proposers and even could not be able, during scrutiny, to indicate in which part Number(s) and Serial Numbers of the Electoral Roll of 113-Bhubaneswar (North) the names of the proposers as signed in the Nomination paper find place. Hence the Nomination paper is found invalid and therefore rejected”<=     In my opinion Sec 33 (4) says: “On presentation of a nomination paper, the returning officer shall satisfy himself that the names and electoral roll numbers of the candidate and his proposers as entered in the nomination paper are the same as those entered in the electoral rolls:”   Sec 36 (4) says: “The returning officer shall not reject any nomination paper on the ground of any defect which is not of a substantial character”   Hence, as per law the Sec 33(4), Sec 36(4) of R.P.Act-1951 not complied by the returning officer, the order found unconstitutional and illegal.
