My name is rajat, I live in a 80 Gaj (Yard) house with my mother, wife and daughters. The property is of my grand father. My grand father, grand mother and my father have been expired. My father has four sisters and now they are claiming their right on property as per law.
I agree with the law that the daughters are equal to their brothers and has the same right on the property but what if the brother has only 1 house in the name of parental property.
All my Bua's (Sister to my father) are living in their maternal houses but still they want share from brother who has only 80 Gaj (yard) house.
This is an injustice to the brothers who will be homeless very soon. My father doesn't have any other property except the house in which he is already living.
Now as per the supereme court law the sisters can sell their shares which is 80 yards in my case. The court should amend the law in order to protect the brothers from this injustice. Court is protecting sisters through this law but where will the brother go who doesn't have another house except the parental house.
I request the court to make necessary amendment in this law.
For example if the brother has another parental property except the house then the sisters are eligible to take share from that additional property.
Or if the sister doesn't have any house.
Or if the sister is unmarried.
There should not be any share for sisters if the sisters are already living in the maternal house and the brother is only having the parental house form his living. In my case I am living in a small house. If the court will give permission to my Bua's then Me, My mother, My wife and My small daughter will be on the street very soon.
