Palu patra

i have 2 brothers and 3 sisters. after my mother's death in the year 2003, my second brother took the signatures of me and my elder brother on white paper and asked us to sign on palu patra written on 10 rupees stamp paper and told us it will help him to get any crop loans etc.,  believing his words we both have signed. Recently he died and when i asked my portion of land and house, my sister in law says she can't part anything from my father's self acquired property. my brother did not take any signatures from my sisters during palu patra. and it is not registered by us also. but got all land and house transfered in his name and done the mutation from local authority. please guide me

What about your father, is he alive?  File partition suit.

The facts posted suggest that the property has been mutated in the name of the deceased brother. However, such mutation  in the revenue records cannot divest other siblings of their right, interest and title in the property left intestate by the deceased father.

The signature obtained by the later brother does not constitute delinquishment of their title to the property.

The siblings can file a partition suit with the legal heirs to the deceased brother as the defendants.

The signatures obtained in an unregistered document is not legally valid hence you may file a partition suit seeking division of property and to allot your rightful share in it.
