Rcr petition & re-join of wife

After RCR filed by husband, wife appear to court on 3rd summan. As wife consent to join with husband and with the case also will be closed. At this situation if  cohabitation not restore how husband will take Divorce by showing RCR case, because the RCR case closed due to wife rejoin.

If there is no decree, the husband cannot file for divorce on the ground of non resumption of cohabitation within one year of the RCR decree. However, he can file on other available grounds.

Archana Madam,

if RCR closed due to wife rejoin without decree passed by court and within 1 year after rcr closed if cohabitation not resume then after 1 year of RCR closed without decree passed how one will take divorce on the basis of RCR ?
