1. I don’t know my share/boundaries in said land.For getting my land measured atleast one year time is required from Land records department. Not sure about will other person will allow Land records dept tp measure the land.

 
2. I want to demand  ‘mesne profits’ from the date of filing my suit.

3.Suit will be for Declaration of my ownership, getting my land ascertained , and ofcourse Possession &

   mesne profit.

4. Section 441. Criminal trespass.  "Whoever enters into or upon property in the possession of another"

    I don’t know whether I can invoke Sec 441 as I was not having possession.

5. Shonee pls provide details/procedure followed for getting your land back.

@Sonee: They are not innovative suggestions but are most commonly used by SDM's, District Magistrates. Section 145 is decided by a Judicial Magistrate as opposed to pre 1973 era when there was no sepperation of judiciary from the executive. The British rulers tried everything like seperating Judiciary from the executive[Lord Maculay and others] but after the crown took over Sir Lawrence as the Governor General introduced the ICS and removed seperation of the executive from the Judiciary which remained subordinate to the executive. The system worked flawlessly but after 1973 the syatem started breaking down to the point of collapse and has now reached a state where judges are defalcating GPF a running scot free. They give royal treatment to Kasab, Guru Afzal and co .Atrocious. Read Nani Palkiwala's book : "Indian Constitution Defaced and Defiled".

@Sultan: Just file the cases, records shall be produced.  A man can Criminally Tresspass when the matter was subjudice in the Court which invite Criminal Contempt of Court. Give me details and I'll guide you better. or enagage an attorney [advocate in the Indian Context] of repute who'll, simply use sections 107 and 116(3)[ crpc]  very effectively as well use section 144 of the Crpc. OR if you want to punish him then use section 109 of CRPC.[Unknown man loitering around under suspicious circumstances]. OR if you want to teach him the lesson of life use section 110 CRPC after making out an effective foolproof case of his being a habitual offender.
