Recovery of vehicle

Dear Experts, ISSUE: X took a vehicle on Monthly Rent Rs.10000 from Y who is a relative to X. Based on that; there is no written agreement exists between them. Later on, they had dispute between them. Y went and asked X to return the vehicle along with rental money. But X refused and threatens Y not to come again for the vehicle. Y reported to the SP of Police and the same has been forwarded to Local Police station for inquiry. During the inquiry, X came and refused to hand over the vehicle and given a written statement stating that he will resolve the issue in the court. Y asked the inspector to issue the CSR for the complaint given to SP. But the inspector refused and told that CSR cannot be issued for forwarded complaints. If you want to get a CSR, make a fresh complaint for the same and close the complaint given to SP by making a statement in writing stating that we do not need any further action on the complaint made with SP. My Doubts: 1. Why Should we a written statement to close the complaint which was made to higher official for no further action required? 2. Can we get CSR for the complaints made to higher official in Local Police station? 3. Is it advisable to give a written statement as required by the inspector since he did not do anything on the complaint except the inquiry? Rgds....

Normally police will give CSR as a receipt of the complaint to the courts order. So you have to give written statement for its cancellation in the court.

2) The FIR will reflect the original complaint and additional information. But, once the FIR is registered you can not change.

If we give complaint to higher officials, will the local police station give the CSR

file a RTI with the SP office asking on why the local police under his jurisdiction cannot issue a CSR for this..just sit and watch ..that should do the trick.

avoid repeated request and visit to the station which will only show your weakness to the police -
