Dear all, in case an execution deed is to be executed, but the seller has expired and the legal heirs are not willing to participate in the process, can a declaration be done and a deed be registered. Kindly respond as the matter is most urgent.

yes,a declaration suit must be filed under section 34 of specific relief act along wih a preventive injunction under section 36 of specific relief act
