Redevelopment

In a general meeting of the society, we propose to take consent of  of members for the redevelopment of the buildings.

  1. What procedure should we follow ?
  2. consent of atleast 75% is sufficient?
  3. To pass a resolution what should be the content of resolution?
  4. Any other imp. and material requirments and suggestions are solicited.

pl. treat this as v. urgent

sir, firstly u should have stated whether yours is a freehold/leasehold/cessed building.

Minimum 15% members of ur society should express their wish and initiative to initiate the process of redevelopment.

The resolution needs to be passed in the AGM and 75% consent is a must for passing the resolutions for redevelopment.

Thereafter you have to appoint experts to prepare feasiablity reports, technical reports, etc.. and also ascertain to  the market value of your property.

Tenders would then be invited from prospective, interested developers.

Refer to the guidelines under section 79 (A) of the Maharashtra Co-operatives act, 1960.

Dear Sir,
Greetings!!! Iam a indian citizen residing in goa, I need some information on the election - model code of conduct.
I have constructed my own house after getting proper necessary permission from the municipal corp. and town planning dept. goa
 Now the work is finished & I applied for a occupancy in the month of Oct. 2011 well before Election model code of conduct is enforced in goa.
My question-
1. I have to wait till the process of election is completed i.e 10th march 2012 to get an house ocupancy from the municipal council?
2. or Iam exculded from this model code.  
3. Iam not belong to any party.
4. can I contact the concerned authority so that i can get a occupancy?
5. I read the FAQ on election code of conduct but iam not satisfied with the info.

Hi,

Our society had decided to undertake redevelopment, after signing the MOU and agreement there were differences with the developer. The developer subsequently filed a suit in the Bombay High Court. In the mean time we the society through our lawyer were negotiating to enable a out of court resolution. But unfortunatly the matter reached a dead end when the developer refused to provide the building plan. During this time whenever the dates where due in the court the lawyer kept postponing them stating that the parties were negotiating on the matter. In April  2011 the society decided to pursue the matter in court as the developer stopped showing any interest. Suprisingly now the court seems to be not taking up the case. Our building requires urgent reconstruction and terrible issue of water logging hence we need to expedite the matter. Is there a way in which we can expedite the matter and bring it up for hearing.
