Redevlopment of co-op housing society

Dear,

Please revert Urgently

Whether there are any judicial judgements given by Honourable courts regarding the redevelopment of the old buildings based on the search report of the Ahmedabad Municipal Corporation , where the report mentions that the infrastructure of the Buildings are too Weak...???

If yes, than Whether the members of the society, relying on such Judgement given by honourable Courts and without concent of 1 members of the society pass a tender giving a contract to Builder for Building a 10 Multistoried building against the current 3 floored building…??

Whether Society Committee can File a writ petition in High Court against the Member who is against the decision taken by the Society of building a 10 multistoried building instead of 3 floored building..???

Whether the member who is against the decision taken by the Society committee have any remedy against it…???

first you need to state what is the reason for that one member to object the re-development of the building?????

 

incase, there is any such objection then the same needs to be brougth officially before the Chairman,Secretary of the building or working committee appointed for the re-development. incase they fail to resolve the dispute then the member needs to move to the co-op. soc. court, the said court are meant for resolving the society issues.

The reason Being the member does not want to reside in a 10 multi storied building, he has already represented verbally abount his unwillingness to chairman and secretary.

However, the Secretary and chairman has not considered it.

The chairman and the secretary has given the member threat of filing a suit against him in court of law.

Can they do so..???

Please suggest what is the remedy the member have against it.
