Regarding fathers property

Dear Sir, we have a flat in ecocity Noida. This flat was in the name of my Father, my brother and me. My father passed away last month and now we want to transfer the property in our names. Can you please let me know what is the formality that we need to complete and do we need to pay for registeration also. If yes then what will be the charges

Randeep ji as u had allready paid the stamp duty and purchase it in your name . Right now only one co owner passes away this does not mean u need to pay again charges for it. If u want to transfer the owner ship then u need to do gift or release deed of that flat other wise no need to do any thing since ownership is with you & your brother.

It i simple case of inheritance as per personal laws applicable to deceased owner.

It is believed that Hindu Succession Laws shall apply.

Confirm.

Obtain death certificate, legal heir certificate/affidavit as applicable per rules of authority under whose jurisdiction property falls, and submit to the authority.

 

Hindu Succession Laws: Mother,wife,sons,daughters are ClassI legal heirs and shall share the estate equally.

Anyone can dipsose his/her share in anyone's favor by a valid deed e.g; sale/gift/relinquishment/release/settlement deed etc...........
