Regarding Gumasta licence

Dear Sir/ Madam Under gumasta license rules (Mumbai) is it mandatory for the shop to remain close for a day in a week ? even :- 1. If the shop is runned by the proprietor (alone) without any employee. 2. Can there be any legal proceedings if the proprietor wishes to keep it's shop open? 3. Have there been any ( new) official announcements by the authority through any circular, that shop could remain open for the entire week. Please help.

under section 18 of Bombay Shop and Establishments Act one day a week holiday is mandatory. and yes as per Jethalal Valand vs Vipinchandra Gandhi 1971 LIC 803/12 Guj. LR 58, both employer and employee are prohibited against service to customer or for doing any business on a closed day and therefore owner giving service to his customers on a weekly holiday is guilty of contravention even there were no employees.
