Regarding judgement

 

In 304B and 498A 

Main accused and co-accused get regular bail from session court.

When we quash the NBW for 58 yrs lady the following judgement.

1.So we get the hearing in same day or get interim bail for 2-3 days.

2. what is the meaning of  Amrawati and another Vs. State of U.P. reported in 2004 (57) ALR 290 as well as judgement passed by Hon'ble Apex Court reported in 2009 (3) ADJ 322 (SC) Lal Kamlendra Pratap Singh Vs. State of U.P.

 

However, it is directed that if the applicant appears and surrenders before the court below within 30 days from today and applies for bail, his prayer for bail shall be considered expeditiously if possible, on the same day in view of the settled law laid by this Court in the case of Amrawati and another Vs. State of U.P. reported in 2004 (57) ALR 290 as well as judgement passed by Hon'ble Apex Court reported in 2009 (3) ADJ 322 (SC) Lal Kamlendra Pratap Singh Vs. State of U.P. For a period of 30 days from today no coercive action shall be taken against the applicant. It is being made clear that in case the applicant failed to surrender before the concerned court within the period indicated hereinabove, this application shall stand dismissed without any further reference to the court below.

It means that the bail would be heard and decided on the same day.

 

If there is no need of any custodial interrogation, the same would be decided in your favor.
