It is mandatory to get the RC transferred as soon as the vehicle is transferred. In this case, the owner will be the person whose name is on the RC and he will have all the legal obligations. But if the sale is completed and sale agreement is signed, the new owner can get the possession of the vehicle and start the process if transfer of RC with the help of the previous owner.
According to the Motor Vehicle Act and Supreme Court Verdict - Car Ownership is considered on the basis of Owner’s name present in RC.
As per the verdict, If a person sells a vehicle without ensuring transfer of Ownership in RC, then the Owner name as per the RC will be held legally liable in case of any Accidents. If you buy a vehicle without ensuring Ownership Transfer, the concerned person can file a case of Cheating or Suspicion of some illegal activities.
Documents required –
• Original RC: Original RC needs to be submitted in the RTO.
• Sale Transfer Forms: RTO Form Number 29, 30 are the Sale Transfer Forms. This needs to be signed by the Seller and Buyer both.
• Self-Attested ID and Address Proof of both the parties
• Self-Attested Buyer PAN card
• Copy of Insurance certificate
• Latest PUC Certificate
• Vehicle Chassis Number Imprint
• Loan Hypothecation Removal
• NOC Clearance Certificate

Step 2- Filling the Transfer Form
Step 3 - Documents Upload
Step 4 – Payment of fees
Step 5 - Submission of Documents in the RTO
Step 6 - Get Transferred RC.
