Release deed challenged by one of the legal heirs

Dear friends My mother passed away interstate almost two years back. And we 4 legal heirs were left. 2 Sons and 2 daughter's. Me along with my brother and one sister made a release deed in favor of me duly, getting it registered post paying the stamp duty applicable. Now the sister who did not transacted in this deed has filed a case stating the release also in her favor in the said property and claiming 50% share in the property.

Who was owner of the property? Mother?

Which personal law is applicable; HIndu?

The rights to mother were passed thru a will of father. And Hindu Succession law applies.

If the relinquishment deed is registered then you will get 3|4th share and the daughter who has not relinquished her share will get 1|4th share

As per registered relinquishment deed you'd get 3/4 th share in your mother's property and your sister would get only 1/4 th share.If you appreciate this answer please click the thank you button on this forum.

Apparently WILL has been acted upon and there has been no cloud on it.

Hindu female's self acquired/absoloute estate devolves upon her sons, daughters, husband.

The claim of your sisiter seems to have no legal force.
