My uncle got my mother and cousin sis(parents no more) while i was working abroad to sign a GPA for our ancestral property (in grandfathers name) back in 2008.Post that he cut ties with all of us and refused to provide us with a copy of the GPA evena fetr repeated requests in the last 4 years.We applied and got the document ourselves now and the document actually turns out to be a release deed for the property
Total property is around 9-10 acres(half of which is his own and is road facing and the ancestral property behind it)
Mother and cousin signed the deed in good faith without going through the deed.No draft was shown whatsoever
The deed was executed in july 2008 just 15 days before i came back to india for good
When we requested for the copy,he dodged us and when i finally met him i person at his home couple of weeks back and demanded the same,he said that he didnt even collect the originals from the registrar's office as he was tied up with both his daughters marriage
In the mean time he has sold his portion(road facing) without leaving access road to the ancestral property at the back
In the release deed he hs also mentioned the ancestal home along with the property without our knowledge
The property is worth in lakhs,but the deed states that my mom and cousin got only Rs.10,000 each for signing the deed.
My 2nd aunt has not signed the deed
How do we go about this now as he has completely conned my mother and cousin by brainwashing them and so forth and this is mental agony/trauma to us.
Is it good to go to the police or through the court?Moreover can all grandson /daughters sue him in court of law?
