About 20 retiredbank officers aged below 65 years were engazed by a nationalised bank on contract for 12 months.The contract was tobe further extendible as per extant policy & rules of the bank at sole discretion of themanagement. The contract period completed on18.12.2012 before which performance appraisals of the individual employees were asked to be submitted to the corporate office of the bank for review and consider about extension of the contract.But due to delay in forwarding the performance appraisal in time by the concerned Regional offices decision at corporate office couldnot be taken
About 20 retired bank officers were engazed by a nationalised bank on contract for 12 months.Eligible age criteria for recruitmen twas below 65 years.The contract was extendible further as per extant policy & rules at sole descretion of the management.Contract period of 12 months completed on 18.12.2012 before which the management could not take decision about extension of the contract due to delay in forwarding necessary feed back in time by its lower offices.under the circumstances all the employees handed over charge to other regular officers on 18.12.2012 as instructed. Since then they had been awaiting order about extension..After pass of about three months orders of extension have been issued on 16.3.2013 to all exept three persons who have crossed 65 years of age as on date of order. I like following clarifications --
1. those below 65 yrs age were eligible for intial appointment & their tenures too were to be extended further as per appointment lettres .Policy regarding extension prevailing on 18.12.2012 should be applied or any other formed thereafter ? Was it necessary for the management to pass prior intimation that those crossing 65 would be eligible for extension?
2.Whether an expired contract can be renewed after 3months .
3.Whether the above extension will be legally treated as fresh appointment ? If to be treated fresh many wont be eligible as per changed eligibility criteris. /
