Request for service Certificate

I was working in IT Company CSC. Now as the time passing I have come across tough time in my personnel life( Mental and Physical Harassment from my Husband and his family for Dowry),which results I took one week leave and my parents came to Hyderabad and discussed with them. with consideration of an agreed  understanding, they left from Hyderabad, shockingly with an immediate night an attempt has been made to kill me by my husband and his family. my relatives rescued and send to my village in that night itself with special transport arrangement.( From the perspective of CSC I took a leave of 1 week and went to my home)

Communication 1: After that completion of the week leave, I have requested my Team Lead with one more week with the notice that I have an entitlement of approximately 40 leaves. And he given his moral support at that time and suggested to resolve the personnel problems and come back to work

 

Communication 2: On the other day evening I have called my team lead and explained my problem very clearly and requested for leave even that might be the loss of pay and requested for support from organization in this tough time. On the aspect of phone call to threaten my life, which I had received from anonymous numbers, expressed my interest to work in either Bangalore or other than Hyderabad location would be ideal to join back my duties at an earliest time and safe for me personally on this current circumstances.( In reference to my phone communication my Team lead has informed to management with the mail, which he has forwarded to me)

 

Communication 3: I have received an absconded notice from CSC with effect from 15th June 2011 saying that I have been absconded, on 22nd June 2011 from my local postal department. with Immediately I have contacted my Team Lead , Project Manager, Senior manager and HR the conclusion of all they are saying is I have not created leave request in ESS, so I have officially not informed any one and so I am absconded and they told I am three days late to respond. But my point of view I haven’t given one opportunity to listen my word even atleast once and I am already stuck with lot of problems so requested they to send my service certificate and full and final settlement. Now I have streamlined my problems and submitted all the CSC Company assets with me .Now after I have submitted assets HR is saying they will not issue any service certificate as I am absconded. I have gone to an extent and said take the notice period weaver money and issue my service certificate and experience certificate. But I haven’t received any further communication from them. I called HR and he is saying they will do full and final settlement initially after that they are not responding to that as well. I have informed the incident to all levels of management and requested for my service certificate but nobody responded( If I called my Senior manager for whom I worked for 3 and half years now he is saying the matter is with management and he can’t help me in any manner)

 

Now I have no idea what to do next and it is already one month past and I do need service certificate to join some other organization. I am an employee who depends on my job for all my expenses

 I request all the experts in this forum please kindly provide your valuable suggestion to get my service certificate

 

1.       I have threat to my life in Hyderabad location so not requesting for further employment with that employer

2.       I have 40 leaves entitlement quota and they given only 15 and sent absconded notice. My Team leader forwarded a mail that he communicated to his manager about my problem

3.        No I only needed the service certificate from that employer (I have worked for 3 and half years without single remark) kindly suggest apart from my requests any one or legally any way that helps me to get my service certificate.

It appears that company has taken a call on your situation and has decided not to keep an employee bogged down by personal problems.

However you should make an attempt.

 

You had an exigency and the situation was extra ordinary and you have been keeping your reporting authority informed. It is believed that you have been making verbal representations only. Hope you have the date time and phone numbers ( from which the calls were made and phone numbers at which calls were made and if you have the bills it is even better).You should have sent an email or letter requesting for leave and extension of leave. Company has stated you did not create a leave request which is probably created on intranet of the company which can not be accessed from outside the office. You have an email copy vide which your reporting authority has explained the situation to his concerned authority.

You can submit a gentle written representation, under acknowledgment, by registered/speed post, followed by email, to your appointing authority, MD/CEO, reporting authority, Company secretary, HR-Head and explain all the events, and conclude that although you had an emergency situation still you sincerely kept in touch with your reporting authority ( mention date, time, phone numbers) and kept him appraised and informed, and hence you have not absconded, and ask their good office to take back the charges of absconding. You can highlight that you have an excellent service record without a single adverse comment, and request their good office to be considerate towards the extra ordinary situation you have faced and give you an opportunity to locate at stations .....mentioned by you. You can enclose copy of the email of your boss. The email of your boss may help you to get some relief.

You should also submit leave application on company format a printout of which you can obtain from your boss or your colleagues, and ask for sanction of leave.

 Wait for a few days for the reply, to your email, and then follow up.

Service certificate or work experience certificate can not be blocked. F&F can also not be blocked. If company is insensitive they may adjust notice pay in your F&F.

If company does not respond or give any relief then you can ask them to accept your resignation and withdraw the charges of having absconded and hence termination of service.

You can also approach labor office, with all records and details and they shall be able to help you. The process is very simple and you can handle it on your own or thru a lbour consultant/lawyer/law firm. You can also seek help from elders in the family, experienced, competent well wishers.
