Road traffic accident

Hi,

One of my friend had an accident near Khed Shivapur. A motor bike rider suddenly crossed the high way from the adjacent road divider where there was no provision for road crossing.

We tried to avoid accident. With great efforts , and application of breaks, car speed was reduced, but coul dnot avoid accident.

The person 62 years old got minor head injury and three fractures on his foot. we shifted him to hospital and paid 10,000/- towards his expenditure. The person is from fire brigade and gets 90% compensation from his department.

Prima facie the fault is on the motor bike rider, and we tried our best to avoid accident. what is out liability in this case. Please guide.

With your given facts, you are safe from any conviction under section 279,336,337,and 338 of IPC. But you must have sufficient evidence that err was on his part and you were not over-speeding of that highway on that day and you followed every norm of Motor Vehicle Act 1988 or Central Motor Vehicle Rules 1989 as the case may be.

 

Now, Do what you think as your moral liability allows you to do.
